Instructions for obtaining Spanish citizenship for a child born in Spain

If a child is born in the Kingdom of Spain, he or she has the right to obtain Spanish citizenship after one year of legal residence in Spain, provided that one of the parents has legal residence status in Spain. For Ukrainians, the period of residence is most often calculated from the date of receipt of the NIE.

You can submit documents either in person (with a digital signature) or through a lawyer. This does not affect the time it takes to process your application.

STEP 1. Filling out the Modelo 790-026 form and paying the fee.

STEP 2. Filling out the application.

This form can be filled out both on a computer in electronic form, and printed and filled out "by hand".

You can sign in person or using a digital signature.

Please note that if you use a digital signature, it should not extend beyond the area designated for the signature. Also, do not reduce the file size after using the signature, as the system may not accept the document.

Recommendation: Reduce the file size before filling out and signing if you decide to use a digital signature.

The following sections of the form do NOT need to be filled out:

– If you are married, indicate your spouse’s data:
– In the event that you have children of minor age:
– If the interested party is part of the staff of the Armed Forces: – DATA OF THE REPRESENTATIVE WITH MANDATE OR POWER
– No consiento en recibir electronic notifications

In section 3 – Reason for representation (mark the correct box)

Choose the first item:

In section 6 – SITUACIÓN DEL/A INTERESADO/A select Nacido en territorio español

Section 7: select the documents to be attached to the application. The following are required:

– Normalized request model.
– Certificate of birth of the country of origin.

– Pasaporte completo en force, así como el anterior según el plazo de residence exigido en cada caso.
– Documento acreditativo del representative/s legal/es.

Section 8. ATRIBUCIÓN DE NOMBRE Y APELLIDOS CON QUE EL/LA SOLICITANTE SERÁ INSCRITO/A SI SE LE CONCEDE LA NACIONALIDAD ESPAÑOLA

The child's first name, father's and mother's last names are indicated (you can choose which one comes first). In some provinces, it is allowed to duplicate one last name twice and choose

NO DESEA INVERTIR LOS APELLIDOS DE SU PADRE Y DE SU MADRE

(For example Ivanov Ivanov)

Advice: You can try to select this option, but the judge may correct the surnames before signing the oath.

Section 9. PAYMENT OF THE TAX

The date of payment of the duty is indicated,

payment order number (codigo NRC) – indicated in the field Reference and En case from pay telemático indicator withdigi NRC

Below are the signatures of the parents: 

Representative legal (if process) – mother's signature,

Representative volunteer (si procede) – father's signature.

STEP 3. Submit an application online.

Verify your identity using a digital signature or Clave.

Press the button Modify Personal Dataand fill in all the fields (physical person, contact details, address).

Press the button – Save, further -  New application.

In the new window, select: Realized by the representative who exercises patria potestad, tutela or curatela and press Create request

Next, each section is filled in, namely:

Data of the interested party – the child's data is indicated.

In the Data for registration in the Civil Registry section, select the surname option that you indicated in the application.

In the section – Documentation – upload scans of documents (child's international passport, child's birth certificate, parents' passports, child's and parents' TIEs, confirmation of payment of duty, completed and signed application (step 3).

In the section – Representatives – information about parents is filled in.

In the section – Notification – specify the contact details where notifications will be sent.

In the section – Tasas – you can choose an item Payment by window and enter the details of the duty paid (date and NRC code).

STEP 4. Confirmation of the filled-in information, signature via AutoFirma.

STEP 5. Notification from the Ministry.

If you need to submit additional documents, you will receive a notification by email from the recipient. no–reply–notification@mail.gob.it

Or a decision will be made on your application.

The approximate time for considering an application is from 3 months (some people have 3, some have 6, but there are cases of 11 months).

STEP 6. The application is confirmed.

After receiving the notification with the status – Granted, you need to download two files: RESOLUTION OF CONCESSION OF NATIONALITY BY RESIDENCE and The Single Enabled Electronic Direction Service (DEHÚ) from the website:

STEP 7. Registration in the Civil Registry.

Within 180 days from the date of opening the resolution from the Ministry, it is important to appear at the Civil Registry Office at the child's place of residence to take the oath and further register citizenship.

Please note that the Civil Registry does not receive your documents automatically; sometimes you have to wait a week for them to gain access to your file.

STEP 8. Submitting documents for oath.

In some cities, you can immediately come with a full package of documents for the oath, according to the appointment.

In some cases, you first bring all the documents, the judge checks them and sets a date for the oath.

List of required documents:

• NIE, TIE of the child and parents
• History of all child registrations for the last 2 years. Pay attention to how long this certificate is valid (!)
• Original birth certificate
• RESOLUCIÓN DE CONCESIÓN DE NACIONALIDAD POR RESIDENCIA
• Extract El servicio de Dirección Electrónica Habilitada Única (DEHÚ)
• Completed form – Declaration of data for registration (in some cities, the judge fills it out himself)
• Marriage certificate (if available), preferably an official translation (jurado)

The presence of both parents is mandatory, or the presence of an official notarized power of attorney.

After completing all the documents, the judge will issue a new birth certificate for the child, already with Spanish citizenship.  

STEP 9. Obtaining a DNI and passport.

An entry (screening) is made at the Policia Nacional at the link https://www.citapreviadnie.es/citaPreviaDni/

For the network, the NIE of one of the parents is indicated, select the category:
FIRST EXPEDITIOŃN DEL ID card Y CITAS MUMULTIPLES
Para el applicant y/o couple minors o people a su cargo y other accompanyantes.

Next, indicate the child's NIE, choose a convenient date and time.

A confirmation email will be sent to your email address.

The presence of both parents and the child is mandatory.

Documents for obtaining a DNI (Spanish citizen ID card, valid within the EU):

• New birth certificate (Certificate literal from birth) – approximately valid 6 months.
• Child's registration (valid for three months from the date of issue)
• Child's photo (32*26 mm, white background)
• Decision on granting citizenship (RESOLUCIÓN DE CONCESIÓN DE NACIONALIDAD POR RESIDENCIA)
• TIE of the child and parents
• The toll (Tasa) is approximately 12 euros, paid on site by card.

The DNI document is issued in up to 20 minutes and immediately handed over to the parents.

After that, it is possible to apply for a passport (for travel outside the EU).

Documents for passport application:

• ID card
• New birth certificate (Certificado literal de nacimiento) – valid for approximately 6 months.
• Child's registration (valid for three months from the date of issue)
• Child's photo (32*26 mm, white background)
• Decision on granting citizenship (RESOLUCIÓN DE CONCESIÓN DE NACIONALIDAD POR RESIDENCIA)
• TIE parents
• The toll (Tasa) is 30 euros, paid on site by card.

The passport is issued in up to 20 minutes and is immediately given to the parents.

STEP 10. Updating data in government agencies.

After obtaining the DNI, it is important to provide the relevant information to the clinic, school, Seguridad Social, etc.
